These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Mexico, while fully respecting and integrating mandatory consumer protection regulations applicable in the United Kingdom, the European Union, and the United States.
Section 2 – Shipping, Delivery & DDP (Delivered Duty Paid)
We cater exclusively to customers located in Europe and the United States.
Dispatch Location: All orders are fulfilled and dispatched from our facility in Mexico.
Logistics Partners: We partner with premium priority courier services, including DHL Priority, FedEx Priority, and UPS Priority, to manage transit.
Handling & Transit Time: Orders are processed and dispatched within 1 to 2 business days. Estimated delivery times range between 5 and 10 business days from the date of dispatch.
Tracking Communications: Automated notifications regarding shipment status—including order dispatch, arrival at intermediate hubs, and local delivery routing—will be transmitted to the email address provided by the customer at the time of purchase.
Delivered Duty Paid (DDP): All orders shipped to Europe and the United States are sent on a Delivered Duty Paid basis. This means all relevant import duties, customs clearance fees, and applicable taxes are managed directly to ensure delivery to your specified destination.
Transit Delays & Investigations: In the event that a shipment exceeds standard transit windows, we will initiate a formal investigation with the respective carrier. Based on the objective findings of the carrier investigation, which we aim to resolve within 10 business days of initiation, we will issue a full refund or arrange a replacement dispatch.
Section 3 – Transfer of Risk and Ownership
For consumers residing within the European Union and the United Kingdom, in accordance with applicable consumer rights legislation, the risk of loss or damage to the goods remains with us until the goods have been physically delivered into the possession of the consumer or a designated third party. Risk does not transfer to the consumer upon handover to the carrier. For consumers in the United States, risk transfers in alignment with local consumer protection standards upon successful physical delivery to the final designated address.
Section 4 – Right of Withdrawal & Returns Policy
4.1 Statutory Right of Withdrawal (European Customers)
Customers residing within the European Union and the United Kingdom have the legal right to withdraw from their purchase contract within 14 days of receiving the physical goods without providing a justification. To exercise this right, the customer must notify our customer service via email at dining@chairpadhub.com within the 14-day window.
4.2 Defective, Damaged, or Non-Conforming Goods
If a product arrives damaged, defective, or structurally compromised, customers in Europe and the United States are entitled to a full remedy.
Notification: Please contact our support team at dining@chairpadhub.com within 14 days of delivery.
Evidence: Customers must provide clear photographic verification displaying the reported defect or damage.
Resolution: Upon verification of the photographic evidence, we will process a full refund or dispatch a replacement order. While a physical return to our international facility is generally waived for confirmed transit damage to minimize environmental impact, Chairpadhub reserves the sole right to request the return of the item or additional verification if deemed necessary for quality control and fraud prevention prior to issuing a final remedy.
Section 5 – Accuracy of Information and Product Descriptions
We endeavour to display the colours, dimensions, and specifications of our dining chair cushions as accurately as possible on our platform. The imagery used consists entirely of original or authorised non-copyright materials. We do not make any exaggerated statements regarding the utility or characteristics of our items.
While we strive to maintain complete accuracy across our platform, we cannot ensure that every detail or system configuration is permanently error-free. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information on the Service is inaccurate at any time without prior notice (including after you have submitted your order).
